Terms of service

These Terms of Service (the "Terms") govern access to and use of the CallMeHot platform ("the Platform", "we"), operated by Circuito Up di Tommaso Ferrari, with registered office at Via Carlo Cattaneo, 5 – 20054 Segrate (MI), Italia (Italia). By using the Platform you fully accept these Terms. If you do not accept them, do not use the service.

1. Age requirement (18+)

The Platform contains adult material and is reserved exclusively for adults (at least 18 years old, or the higher age required by your jurisdiction). By registering you declare and warrant that you are of legal age. We reserve the right to request age verification at any time and to suspend accounts that do not pass it.

2. Account

• You are responsible for the confidentiality of your credentials and for all activity carried out from your account.
• The information provided must be truthful and up to date.
• You may not transfer your account or use it on behalf of third parties without authorization.

3. Roles: fans and creators

Users may enjoy the content ("fans") or, after identity verification, publish and sell content ("creators"). Only verified creators may upload content, offer services and receive payments. The rules on content and consent are described on the Acceptable use and Consent and verification pages.

4. User content

Creators retain the rights to their own content and grant CallMeHot a non-exclusive, worldwide, royalty-free license to host, reproduce, technically adapt (e.g. compression, previews, watermark) and display the content in order to provide the service. The creator warrants that they hold all rights and consents required for each published content, including the releases of every person depicted. All user-uploaded content is subject to pre-publication review by our team before it is published, to verify that it is not illegal and complies with our rules (see Acceptable use): non-compliant content is not published or is removed.

5. Payments

Payments are processed by our payment service provider CCBill. The economic conditions and refunds are described on the Payments and refunds page. Purchases are made via prepaid tokens: fixed-price packages, tips and unlocking individual premium content are one-off purchases; an optional, recurring VIP subscription to a creator is also available and can be canceled at any time. The Platform retains a commission on creators' sales, indicated in the Earnings section.

6. Prohibited conduct

It is forbidden to publish illegal, non-consensual content or content depicting minors, to circumvent payment or verification systems, to infringe others' rights, to perform unauthorized scraping, to spread malware or to harass other users. Violations result in removal of content, suspension or closure of the account and, where appropriate, reporting to the authorities. See Acceptable use and Anti-trafficking policy.

7. Intellectual property

Trademarks, logo, software and design of the Platform belong to Circuito Up di Tommaso Ferrari or their respective owners. For copyright infringements see the DMCA procedure.

8. Suspension and termination

We may suspend or close an account that violates the Terms or the law. You may close your account at any time; legal obligations regarding record-keeping (see §2257) and any amounts due remain in force.

9. Disclaimers and limitations of liability

The service is provided "as is". To the extent permitted by law, we are not liable for content published by users or for indirect damages. Nothing in these Terms limits consumers' mandatory rights.

10. Changes

We may update the Terms; significant changes will be communicated with reasonable notice. Continued use after they take effect constitutes acceptance.

11. Applicable law and jurisdiction

These Terms are governed by the law applicable at Foro di Milano, Italia, without prejudice to the consumer's mandatory jurisdiction.
